New Delhi: The release of 11 men serving life term for the gangrape of Bilkis Bano and the murder of her family during the 2002 Gujarat riots, is “appeasement of lawlessness politics” which is a conspiracy forecasted ahead of the Gujarat State Assembly elections said Rastriya Jana Parishad (National Public Council) Chancellor MA Mujeeb.
“It is unfortunate as the Prime Minister talked about 75th Azadi Ka Amrit Mahotsav while it is shameful on the part of Prime Minister Narendra Modi having spoken about more power to women from Red Fort on Independence Day” Chancellor of NPC said.
The drama of release of dangerous convicts is sending a wrong message to the Muslim World and setting a wrong precedent,” Mujeeb a leading advocate at High Court said.
“RSS through the criminals has committed crime against Bilkis Bano and continue to do so against the State in particular and Muslim Minorities in General. Fresh wounds are given to Bilkis Bano. Nation hopes good sense of Dharma would prevail in the RSS and BJP, Mujeeb said.
“To win at election, BJP and its Union Home Minister and crime manipulating Narendra Modi can do anything in elections as the Elections are round the corner in Gujarat. It appears that the RSS is guiding the BJP ruling States to follow the spirit of Adharna as invoked by the Manusmrithi constitution. The natural justice guaranteed by the Constitution of India, In this case Rule of Adharma is displayed by abusing the powers of the State while hoping for another term of power in Gujarat”, Mujeeb pointed out.
In June the Centre had said that rape convicts cannot be released under a special release policy for convicted prisoners as part of the “Azadi Ka Amrit Mahotsav” celebrations. But those guidelines may not be applicable to BJP and RSS criminals and in this case, Mujeeb who is also the national president of All India Muslim Federation said.
The Gujarat government had released the men following its own policy under the Supreme Court’s directions in May to consider a remission plea by one of the convicts.
“The BJP is completely biased to people practicing a certain religion. Why are people in jail for Godhra? They don’t care about rule of law and Dharma Shasthra”, Mujeeb questioned the administration of justice. They have also committed crime again the State, but lessor crime?. They have no remorse, Mujeeb lambasted the BJP style of administration of Justice, abuse of the powers of the State despite the BJP Govts take oath to abide by the Constitution of India.
Bilkis Bano, 21, was five months’ pregnant when she was raped on March 3, 2002. Her toddler daughter was among the seven family members murdered the same day. The family was hiding in fields near Ahmedabad as violence erupted in the aftermath of the burning of a Sabarmati Express coach that killed 59 ‘kar sevaks’. International investigative agencies pin point that it was also handiwork of RSS to create fear among the Muslim Minorities, Mujeeb said.
It may be recalled that in 2008, a special court in Mumbai sentenced the 11 men to life term – a sentence that was upheld by the Bombay High Court.
“Crimes against the Muslims in India should be governed by the Islamic Criminal Law. Islamic Law should be applied even against the State sponsored crimes against the Muslims and their assets. The International Criminal Court should take suo motto cognizance in the failure of the administration of criminal justice in India wherever the Muslim victims are arrayed as accused under BJP’s respective State’s under the Control of Organised Crime Act. State can not ignore the constitutional rights of her Muslim children. India is bound to uphold international treaties in administration of free and fair criminal justice in India, Mujeeb who is ex-officio President of All India Muslim Federation, demanded.
